Recent Citrus County DUI Results

Inverness, Citrus County.—The Citrus County law enforcement officers stopped the client for allegedly “weaving” within his lane. Later, he was asked to perform roadside or field sobriety exercises.

He agreed and performed poorly, which was corroborated by the video taken by the roadside. The client was arrested for DUI and taken to jail for a breath test. The client refused the breath test, and his license was taken from him.

Prior to trial, the attorneys at the Law Offices of Whittel & Melton moved to suppress the videotape in the case, as it was not turned over promptly under the client’s constitutional right to discovery. The motion was granted, and the Court barred the State from using the video at trial. The case was then tried before a jury in Citrus County.

VERDICT: NOT GUILTY.

Inverness, Citrus County—The client was traveling home from Crystal River. Before leaving Citrus County, the client took a wrong turn onto an access road just before going to the bridge across from Levy County. The client was followed by police and stopped by a Crystal River Police Officer for suspicion of DUI.

The client performed poorly on roadside or field sobriety exercises and produced a breath sample over the legal .08 limit.

The Law Offices of Whittel & Melton immediately investigated the lawfulness of the traffic stop. They prepared a motion to suppress the stop as a violation of the client’s 4th Amendment Right Against Unreasonable Search and Seizure.

RESULT: The State dropped DUI. The case was pleaded to reckless driving with no license suspension.
