Homicide
Murder and Manslaughter
In Florida, murder and manslaughter are both classified as forms of homicide. A conviction for either charge almost always results in a jail or prison sentence.
Murder (Florida Statute § 782.04)
Murder is the unlawful killing of another person. It can be committed in various ways and carries severe penalties, including long mandatory minimum prison sentences.
Manslaughter (Florida Statute § 782.07)
Manslaughter, in the other hand, involves the killing of a person due to culpable negligence without lawful justification. Culpable negligence goes beyond ordinary negligence, showing a reckless disregard for human life and the consequences of one’s actions. If a firearm is involved, a mandatory minumum sentence applies.
